Official Rules

CONTEST DESCRIPTION: The Advil Stories Contest (the “Contest”) starts at 12:00 p.m. Eastern Time (“ET”) on September 15, 2011 and ends at 12:00 p.m. ET on December 14, 2011 (“Contest Period”). The Contest Period consists of an entry phase that begins on September 15, 2011 at 12:00 p.m. ET and ends on October 31, 2011 at 12:00 p.m. ET (the “Entry Phase”), a judging phase that begins on November 1, 2011 and ends on November 11, 2011 (the “Judging Phase”), and a public voting phase that begins on or about 12:00 PM ET on November 30, 2011 and ends at 12:00 PM ET on December 14, 2011 (the “Public Voting Phase”). The Contest provides entrants with the opportunity to create a short video of his/herself sharing their Advil or Advil PM Story and why they love and trust Advil (the “Video”) and to submit the Video for consideration. Eligible Videos will be reviewed by a panel of judges determined by the Sponsor who will select ten (10) Finalist Videos and twenty-five (25) Runner-Up Videos (as determined by the judging criteria). Finalists will be notified on or about November 14, 2011. The ten (10) Finalist Videos will be posted online for public voting during the Public Voting Phase. Grand & First Prize Winners will be announced on or about December 15, 2011. The Sponsor of the Contest is Wyeth LLC, 5 Giralda Farms, Madison, New Jersey, 07940 (“Sponsor”). By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects, and agrees to be contacted by Sponsor via email or telephone.

ELIGIBILITY: Open only to legal residents of the fifty (50) United States (“US”) or the District of Columbia (“DC”), who are eighteen (18) years of age or older, or the age of majority in their state of residence, whichever is older, as of date of entry. Employees, officers and directors of Sponsor, its parent, subsidiaries, and affiliated companies, advertising, promotion, or production agencies, and web masters/suppliers (collectively, the “Contest Entities”) and their IRS dependents and immediate family members (spouse, parents, children, siblings) and individuals residing in their same household (whether or not related), are not eligible to participate. Void outside of the US and DC, and where prohibited by law. This Contest is subject to all applicable federal, state and local laws and regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: To enter, go to http://www.takeadvil.com (the “Website”) and follow the on-screen instructions to register for the Contest and upload your Video for submission into the Contest. Each Video that is submitted into the Contest must meet the following “Video Requirements” (any Video that, in Sponsor's sole and absolute discretion, violates the following criteria will be disqualified):

  • Videos must reference Advil or Advil PM only. Videos must NOT reference Children's Advil, Infant's Advil, Advil Cold & Sinus, Advil Congestion Relief or any other brand;
  • Videos must be a minimum of thirty seconds (:30) and no greater than sixty seconds (:60) in length and may not exceed 50 MB in file size;
  • Video must be submitted in one of the following formats: avi, .wmv, .mov, .3gp, .mpg, .mp4;
  • Videos must be in English;
  • Videos must NOT contain music of any kind
  • Videos must NOT contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, dangerous, threatening, profane, or harassing; or material that contains any derogatory references to any Contest Entities or any third parties;
  • Videos must not contain any inappropriate (in the sole discretion of Sponsor) clothing or adornment;
  • Videos must not contain any depictions of actual use of Advil;
  • Videos must not contain any content or references to the use of Advil that is inconsistent with the indications contained on the product label, or is otherwise contrary to FDA regulations;
  • Videos must reflect the honest opinions, findings, beliefs, and experience of the entrant;
  • Videos must not contain any inaccurate, unsubstantiated or misleading claims about Advil;
  • Videos must not contain the last name, phone number(s), address, or email address of any person or entity, including the entrant;
  • Videos must not contain or otherwise make available any unsolicited or unauthorized advertising, “commercial pitch,” promotional materials, junk mail, spam, pyramid schemes, or any other form of solicitation;
  • Videos must not contain or transmit any materials that contain software viruses or other computer code, files or programs designed to impair, limit, interfere with or cause harm to any communications network operated by any of the Contest Entities or the computers of any individual or entity participating in or otherwise associated with the Contest;
  • Videos must be entirely original to the entrant and must NOT include mention of any famous or notable entity or person(s) whether living or deceased, or performance of any copyrighted materials including, but not limited to photographs, music, films, books, television programming, etc., or identifying descriptions of any media property;
  • Videos must NOT have been previously submitted to another contest, broadcast on a media network or submitted to any entertainment entity that would conflict with this Contest, as determined in the Contest Entities' sole discretion;
  • Videos must NOT include third party names, images, likenesses, brand names, trademarks, logos, insignia, location signage, photographs, artwork, or sculpture, except for those belonging to Sponsor;
  • Videos may NOT include voices images and/or likenesses of persons other than the entrant

As part of the Contest entry process, entrants will be required to indicate that they have read, accept, and agree to be bound by these Official Rules. These Official Rules are accessible throughout the Contest Period. Limit: one (1) entry per person during the Entry Phase. If any individual, in the sole discretion of Sponsor, is suspected of submitting entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple e-mail accounts, they will be disqualified from participation in this Contest. The name of the person submitting the Contest entry must be the authorized account holder of the corresponding email address used for Contest registration, or the entry may be deemed void in Sponsor's sole discretion. In the event of a dispute over the identity of a potential winner, the entry will be declared made by the authorized account holder of the email address submitted at the time of entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her e-mail address, or postal address during the Contest Period. Proof of submission of entry does not constitute proof of delivery of entry. Each entry must be manually key stroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked. No other forms of participation are valid. Sponsor's computer is the official timekeeping device for this Contest.

JUDGING PHASE & NOTIFICATION: During the Judging Phase, representatives of Sponsor will judge all eligible Videos based on the following judging criteria: Relevance to the Contest Theme – 30%, Clear and Positive Message – 25%, Originality – 25%, and Believability of Story – 20%. The judging of Videos will be conducted under the supervision of Sponsor whose decisions are final and binding in all respects relating to selections. A total of ten (10) Finalists and twenty-five (25) Runner-up entries will be selected. The ten (10) Finalists will proceed to the Public Voting Phase for a chance to win the Grand Prize. In the event of a tie, the tied entrants will be re-judged by an additional judge who will serve as a tie-breaker using the same criteria as outlined herein. Each of the ten (10) potential Finalists, as determined by the Judging Phase will be notified by telephone, email and/or overnight mail on or about November 14, 2011 and will be required to respond (as directed) to the notification attempt within three (3) calendar days (or a shorter time if required by exigencies). The failure to respond timely to the notification may result in forfeiture of participation in the Contest and, in such case, the Sponsor may select an alternate Finalist according to the aforementioned judging results. Potential Finalists will be required to execute and return an affidavit of eligibility, a liability release and, unless prohibited by law, a publicity release and other related documents required by the Sponsor (the “Finalist Documents”), within a reasonable amount of time, as determined by the Sponsor in its sole discretion. Potential Finalists will NOT be included in the Public Voting Phase for the selection of the Grand Prize Winner until all such properly executed and notarized Finalist Documents are returned. Sponsor shall have no liability for any Finalist notification that is lost, intercepted or not received by a potential Finalist for any reason. If any potential Finalist does not respond within the time required by Sponsor, or if the Finalist notification is returned as unclaimed or undeliverable to any potential Finalist, such potential Finalist will forfeit and an alternate Finalist may be selected. If any potential Finalist is found to be ineligible or if he or she has not complied with these Official Rules such potential Finalist will be disqualified and the entrant with the next highest scoring Video will be selected.

PUBLIC VOTING PHASE AND PRIZE SELECTION: During the Public Voting Phase the confirmed Finalists' Videos will be posted on the Website and the general public will have the opportunity to vote for their favorite Finalist Video. The Grand Prize Winner will be determined based on the total number of votes received for each Video. In the case of a tie for the Grand Prize, the tied entries will be judged by a panel of judges selected by Sponsor using the judging criteria noted above to determine the winner of the Grand Prize. Finalists will be disqualified if automatic voting software is used in their favor or if Sponsor determines, in its sole discretion that said Finalist tampered with the voting process or participated in, induced, or caused in any way any false, fraudulent, or improper voting. Limit one (1) vote per Video per person per day. Votes generated by a macro, script, bot or other automated means, as well as the use of multiple, false or fictitious accounts or e-mail addresses, are strictly prohibited during any stage of the Contest and votes in excess of the stated limitations may be disqualified at the sole discretion of the Sponsor.

PRIZES: One (1) Grand Prize: $25,000, a trip to New York City, including a meal with Regis and Joy Philbin, and Video may be featured on Advil.com, approximate retail value (“ARV”) $30,600. The trip portion of the Grand Prize consists of a three (3) day/two (2) night trip for the winner and one (1) guest to New York, NY. Trip includes round-trip coach class air transportation from the major airport nearest winner's residence (as determined at the sole discretion of Sponsor), two (2) night's hotel accommodations (one room, double occupancy), weekend car service, two (2) tickets to a Broadway show, two (2) passes to the Natural History Museum, two (2) tickets on CitySightNY Hop-on Bus, Tea for two (2) at the Plaza, two (2) tickets to Top of the Rock, one (1) dinner for two (2) and a meal with Regis and Joy Philbin at a date, time, and location of Sponsor's choosing. Sponsor reserves the right to substitute ground transportation if Grand Prize Winner resides within 150 miles of New York City. Grand Prize Winner and Guest must travel on the same itinerary. Grand Prize Winner and Guest must travel on the dates specified by Sponsor or the trip portion of the prize will be forfeited. Guest traveling with Grand Prize Winner must be eighteen (18) years of age or older, or the age of majority in his/her state of residence, and will be required to execute a liability release and, unless prohibited by law, a publicity release and other related documents required by the Sponsor (“Travel Companion Documents”) to travel on the trip; failure to return such Travel Companion Documents within the time frame specified by Sponsor may result in forfeiture of the Grand Prize and selection of an alternate winner in the Sponsor's sole discretion. Travel restrictions, conditions and limitations may apply. Travel arrangements are subject to availability and must be roundtrip. Sponsor and agencies shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same or for any lost tickets, vouchers or other documentation required to attend or participate in any of the prize-related activities. Sponsor reserves the right to cancel or modify the trip portion of the Grand Prize and award a substitute prize of comparable or greater value, which may include, but is not limited to, a cash prize equivalent to the ARV of the trip. The timing of the meal with Regis and Joy Philbin is subject to their availability. In the event a meal does not take place, there will be no replacement for this portion of the Grand Prize. Nine (9) First Prizes (Non Grand Prize Winning Finalists): $1,000 and four (4) 100 count bottles of Advil, ARV $1,048 ea.; Twenty-Five (25) Second Prizes (Runner-Up): Pain Care Package to include four (4) 100 count bottles of Advil and one (1) Thermacare HeatWraps – Back and Hip – 2 Count and a $100 Spa Finder Gift Card (recipient to determine service location), ARV $160 ea. Cash prizes will be awarded in the form of a check made payable to the winners. If for any reason, Sponsor is unable to or decides not to use the Grand Prize Video on Advil.com, the Sponsor shall have no further obligation to the Grand Prize Winner other than to award the remainder of the Grand Prize. All federal, state and local taxes are the sole responsibility of the winner. No substitution, cash redemption or transfer of prize, but Sponsor reserves right to substitute prize(s) with prize(s) of equal or greater value if any advertised prize becomes unavailable.

REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION: Each person who enters this Contest represents and warrants as follows: (i) the Video is the entrant's own original, previously unpublished, and previously unproduced work; (ii) the Video does not contain any computer virus, is otherwise uncorrupted, is wholly original with entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Video does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; (iv) the Video complies with all Video Requirements stated herein and (v) the Video does not and will not violate any applicable laws, and is not and will not be false, misleading, defamatory or libelous. Each entrant hereby agrees to indemnify and hold the Contest Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of the Video or any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

GRANT OF RIGHTS: Each entrant into the Contest hereby irrevocably grants to Sponsor, its affiliates, successors, licensees and assigns, the non-exclusive, irrevocable, fully paid, royalty-free license to use, copy, sublicense, transmit, distribute, publicly perform, publish, exhibit, perform, create derivative works of, delete or display the Video, in whole or in part, in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Contest and any other promotions. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Video for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

PUBLICITY RELEASE: By participating in the Contest, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any entrant or winner of the Contest, each entrant irrevocably grants (and winner agrees to confirm grant in writing) without any additional compensation whatsoever, or any right of review or approval, the Sponsor and its affiliates, successors, assigns and licensees, the worldwide perpetual right to use such entrant's name, likeness, image, portrait, voice, address, biographical information and Video in any and all media, whether now known or hereafter developed, for any purpose, including without limitation, advertising, trade and/or promotional purposes as well as in, on or in connection with the Website or the Contest or other promotions, and hereby release the Sponsor from any liability with respect thereto.

GENERAL CONDITIONS: Entrants agree that Sponsor, its parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, agents, successors and assigns are released, will have no liability whatsoever for, and shall be held harmless by entrants (and an entrant's parent/legal guardian, if entrant is a minor) against any liability for any injuries, losses, damages, costs or expenses of any kind to person(s), including without limitation, personal injury and/or death, or property damage resulting in whole or in part, directly or indirectly, from entrant's preparation for or participation in Contest, or acceptance, possession, misuse or use of the prize , participation in any prize-related travel or activity, and for claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. LIABILITY LIMITATIONS: Neither Sponsor nor its agencies are responsible for lost, late, misdirected, incomplete, or non-delivered entries or e-mail; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Contest or otherwise attempt to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, as solely determined by the Sponsor, will be disqualified. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. Neither Sponsor nor its agencies are responsible for injury or damage to entrants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Website. Should any portion of the Contest be, in Sponsor's sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of the Website. In no event will Sponsor, its parents, affiliates, subsidiaries and related companies, their advertising or promotion agencies or their respective officers, directors, employees, representative and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the Website, or downloading from and/or printing material downloaded from said Website. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants' rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to any choice-of-law or conflict-of-law rules (whether of the state of New York or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the state of New York.
